Welcome to Theorycraft Games! This privacy policy explains what we collect when you visit or use our games and websites ("Services") and how we might use or share it. We are describing our own practices. This notice doesn't apply to third parties.

What Personal Information do we collect?

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual ("personal information").

Theorycraft Games does not share your personal information for cross-context behavioral advertising, or profiling. We do not knowingly collect, sell, or share personal information of children under sixteen (16); collect, sell, disclose or share sensitive personal information (as defined below); or sell personal information.

For the purposes of this privacy policy sensitive personal information means, to the extent applicable in each jurisdiction, data on race or ethnic origin, religious beliefs, genetic data, biometric data, trade union membership, criminal conviction data, health data, sexual orientation, or philosophical beliefs. In particular, as part of our Services, we collect the below categories of personal information. Some personal information included in this category may overlap with other categories.

Identifiers, identity data and technical data. We may collect your real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol (IP) address, email address, account name, telephone number, or other similar identifiers. We collect your email address for campaign mailing list, account creation, validation, and account log in, and VIP tracking (e.g., brand partners and influencers).Theorycraft account ID is used to identify a particular account in the Services. Third party account ID (e.g., your account ID on Steam) is used to enable login to an account, e.g., Discord channel access. Your address is used for matchmaking players with other players in the same region for better ping. Social media identifier of content creators can be used in Theorycraft marketing and promotions (e.g., posting a leaderboard on Theorycraft Twitter).

Commercial information. We may collect records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. We collect these data to optimize our business, serve personalized discounts within the Services and provide support on issues like refunds.)

Internet or other similar network activity. We may collect your browsing history, search history and information on your interaction with our Services. We collect these data to optimize our business, improve our Services and provide support.

Usage Data. We may collect information about how you use our Services and also how you engage with our content.

Communications Data. We may collect your preferences in receiving communications from us and, where applicable, your opt-in to receive such communications.

Geolocation data. We may collect your device location or other geolocation information, including the zip code, state or country from which you accessed the Services. This information is collected to provide customized Services, better in-game experience, marketing campaigns, and provide support. If you no longer wish for us and/or our service providers to collect and use location information, you may disable the location features on your device. You may consult your device manufacturer settings for instructions. Please note that if you disable such features, your ability to access certain features, Services, content, promotions, and/or products may be limited or disabled.

Inferences drawn from other personal information. We may build a profile reflecting your in-game behavior to improve product offering and define our audience.

Hardware data. We may record data about your computer or device such as what CPU and GPU you have.

Use of Cookies and other Tracking Technologies. We may also use various methods and technologies to store or collect information about your device ("Tracking Technologies"). Tracking Technologies may set, change, alter and/or modify settings or configurations on your Device. You can typically remove or reject cookies via your browser settings. To do this, follow the instructions provided in your browser (usually located within the “settings,” “help,” “tools” or “edit” facility). Many browsers are set to accept cookies until you change your settings. If you disallow cookies, you will not have the advantage of having certain sections of forms being prepopulated for you, and you may not be able to access certain parts of our website or portal. In addition, we may also collect your personal information via third parties such analytics providers, search information providers or marketing analytics service providers.

Recognition Technologies. Technologies, including application of statistical probability to data sets, which attempt to recognize or make assumptions about users and devices (e.g., that a user of multiple devices is the same user).

How do we collect your Personal Information?

Our Services obtain the categories of personal information listed above from the following categories of sources:

Playtest Signup: When you sign up for a playtest we collect information from you including but not limited to your email address, discord ID, steam ID, region and age.

Account Creation: We record your user name when you create your account either manually or automatically via Steam, Epic, Discord and other platforms.

Website: Your use of our website (your web browser, type of devise, IP address, timestamp of when you loaded the pages).

Games and Services: Your use of our Services (account name, chat (text and voice), IP address, how you played the game and what you have clicked on).

Payment Service Providers: we may receive information from our payment providers necessary to process your in-game purchase.

Other Third Parties: We may also collect your personal information via third parties such as analytics providers, search information providers or marketing analytics service providers.

Why and how do we use your Personal Information?

We only use the personal information you provide in a manner that is consistent with this privacy policy and where the law allows us to. We use your personal information for the following purposes:

  • To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to request a price quote or ask a question about our products or services, we will use that personal information to respond to your inquiry. If you provide your personal information to purchase a product or service, we will use that information to process your payment and facilitate delivery. We may also save your information to facilitate new product orders or process returns.To provide, support, personalize, and develop our Services.

Who do we share your Personal Information with?

We may share your personal information by disclosing it to a third party for a business purpose. We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the personal information confidential, and prohibit using the disclosed information for any purpose except performing the contract. We require all third parties that we work with to treat your personal information as confidential and to fully comply with all applicable data protection and consumer legislation.

We disclose personal information for a business purpose to the following categories of third parties:

  1. providers of marketing services (e.g., Mailchimp, Airtable, and Discord);

  2. infrastructure service providers (e.g., AWS, Accelbyte, Snowflake, Zapier, Sentry);

  3. payment providers, data matching, data analysis or direct marketing companies to perform services on our behalf who will only be permitted to use your personal information for the purpose of performing that particular function strictly in accordance with our instructions and not for any other purpose;

  4. customer support providers; and/or

  5. providers of internal communication tools.

We may aggregate, de-identify, and/or anonymize any information collected through the Services to the extent that such information is no longer linked to your personal information. We may use and share this aggregated and anonymized information (non-personal information) for any purpose, including without limitation, for research and marketing purposes, and may also share such data with our affiliates and third parties.

We may also disclose your personal information to third parties in limited circumstances such as:

  1. to comply with our legal and regulatory obligations;

Theorycraft will not sell or rent your personal information to anyone. To the extent permitted by law, we will only share personal information about you with other companies or people when:

  1. We have your consent to share your information;

  2. We need to share your information to provide the product or service you have requested;

  3. We need to send your information to companies who work on behalf of Theorycraft to provide a product or service to you or Theorycraft (unless we tell you differently, these companies do not have any right to use the personal information we provide to them beyond what is necessary to assist us);

  4. We respond to subpoenas, court orders, or legal process or as otherwise required or permitted by law;

  5. We find that your actions on our website or portals violate the Terms of Use, or any of our usage guidelines for specific products or services;

  6. With a purchaser or a potential purchaser of our business. We have a legitimate business interest to do this: to assist with the sale or potential sale of our business;

  7. With third party payment processors, data matching, data analysis or direct marketing companies to perform services on our behalf who will only be permitted to use your personally identifiably information for the purpose of performing that particular function strictly in accordance with our instructions and not for any other purpose; and

  8. With our professional advisers such as our lawyers, bankers, auditors and insurers who assist us in running our business and to comply with our legal obligations.

"Do Not Track" Signals

Some newer Internet browsers have Do Not Track features however our Services do not respond to them. There is not yet a common understanding of how to interpret the Do Not Track signal.

Your Rights

Theorycraft Games allows you to correct, amend, delete, or limit the use of your personal information. You may update, correct, or provide additional information to your personal information by resubmitting your information or contacting us directly. If you are correcting information provided to a third party please correct your information via the methods and direction provided by the third party. If you wish to be informed what personal information we hold about you and if you want it to be removed from our systems, please contact us via any of the contact options provided at the end of this privacy policy. You have the right:

  1. To know what personal information we maintain about you.

  2. To receive a copy of your personal information in a structured, commonly used and machine-readable or commonly used electronic format on request.

  3. To update and modify personal information is incorrect or incomplete.

  4. To object to our processing of your personal information for direct marketing.

  5. To delete or restrict how we use your personal information, but this right is determined by applicable law and may impact your access to some of our Services.

  6. To opt-out of "sale"/ "sharing" of your personal information ––We do not currently consider the ways we shared consumer personal information in the past 12 months to comprise the "sale" of personal information. For purposes of this privacy policy, "sell" means the sale of your personal information to an outside party for monetary or other valuable consideration, subject to certain exceptions in applicable privacy laws.

  7. To limit use of sensitive information. This right is limited to sensitive personal information used for the purpose of inferring characteristics about an individual. We do not collect sensitive personal information nor do we use sensitive personal information for the purpose of inferring characteristics about an individual, therefore we do not offer a path to exercise this right.

Right of non-discrimination and non-retaliation. This right prohibits:

  2. charging different prices or rates for those goods and services, and/or

  3. providing a different level or quality of those goods or services, as a result of the individual exercising any right(s) under any data protection and/or privacy laws and/or regulations. We will not discriminate against you because you made any of these requests. We will not:

  2. charge you different prices or rates for those goods or services, including through granting discounts or other benefits, or imposing penalties;

However, we may offer you certain financial incentives that can result in different prices, rates, or quality levels. Any permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

Shine the Light. California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, to process transactions and facilitate customer requests, and/or to protect against fraud and other misuse of our Services. We will take reasonable steps to verify your identity prior to responding to certain of your requests. The verification steps will vary depending on the sensitivity of the personal information. In some locations, you may designate an authorized agent to make a request on your behalf. When submitting such a request, please ensure you have adequately identified and authorized anyone acting on your behalf.

Response Timing and Format

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt, unless an earlier response is required by the applicable privacy laws. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically as a set of files, formatted in .json delivered electronically as a .zip.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee (only in circumstances where this is not prohibited by the applicable privacy laws), we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Cross border data transfers

Where we transfer personal information to one of our group companies or to our service providers or other third parties (identified above) based outside the European Economic Area or UK, we ensure the transfer is either (a) to a country deemed to provide an adequate level of protection by the European Commission, the UK or Switzerland (as relevant) or (b) pursuant to specific contracts approved by the European Commission or the relevant local regulator. Please contact us if you want further information on the specific mechanism used by us when transferring your Personal Data out of the EEA, UK or Switzerland.

Data Retention

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. We continually review what information we hold and will delete personal information which is no longer required. Different retention periods apply to different types of data.

Changes to this Privacy Policy

We may change this privacy policy from time to time. We will notify you by posting the changed privacy policy on this page with a new "Last Updated" date.

You are advised to review this privacy policy periodically for any changes. Changes to this privacy policy are effective when they are posted on this page.

Children's privacy

Our Services are not aimed at children. We do not request, or knowingly collect, any personal information from children under the age of 16. We allow creation on an account only for children 16 years of age and older.

If we discover that we have collected information of a child under 16 we will immediately delete such information and associated player account. If you are the parent or guardian of a child under 16 who you believe has provided their information to us, please contact us at [email protected] to request the deletion of that information.
